1. Acceptance of Terms
By accessing or using the Kelvia platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms constitute a legally binding agreement between you and Santiago Moreno Arce operating as Kelvia.
2. Description of Service
Kelvia provides an AI front desk and customer operations platform for businesses, including automated call and chat handling, appointment booking, lead capture, intake forms, reminders, reputation workflows, integrations, analytics, and multi-channel communication. The Service is offered as a multi-tenant SaaS platform with different subscription tiers.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must notify us immediately of any unauthorized use. Each tenant organization may have multiple users with different roles (admin, staff).
4. Payment and Billing
Paid plans are billed monthly via Stripe. Credits are consumed per minute of AI call time (1 credit = 1 minute, rounded up). Unused credits do not roll over unless specified in your plan. You may purchase additional credit packs at any time. Refunds are handled on a case-by-case basis within the first 14 days.
5. Data Processing
We process personal data in accordance with our Privacy Policy and applicable data protection laws (GDPR). Call recordings, transcripts, and customer data are stored securely and scoped to your tenant. You retain ownership of your data. We act as a data processor on your behalf.
6. Intellectual Property
The Service, including its design, code, AI models, and documentation, is owned by Santiago Moreno Arce operating as Kelvia and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
7. Limitation of Liability
The Service is provided "as is" without warranties of any kind. Kelvia shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim. We do not guarantee uninterrupted or error-free service.
8. Termination
Either party may terminate the agreement at any time. You may cancel your subscription through your billing settings. Upon termination, your access will cease and data will be retained for 30 days before permanent deletion, unless legally required to retain it longer.
9. Governing Law
These terms are governed by the laws of Spain and the European Union. Any disputes shall be submitted to the courts of Barcelona, Spain, unless EU consumer protection regulations provide for a different jurisdiction.
